Terms of Use

Service
The Socialight service (the Service) is owned and operated by Kamida, Inc. (Kamida). Your use of this service indicates your agreement to be bound by these Terms of Use. If you do not agree with the foregoing terms and conditions, you may not access or otherwise use this service.

Socialight is a social information platform that incorporates media content provided by its users and provides means for users to communicate with each other without mediation. As such, it is difficult to exert a great deal of control over the service. To help us keep Socialight a safe, fun environment for all its users, you must abide by these Terms of Use.

The Socialight platform is hosted in the U.S. Your data will reside in the U.S. and be subject to U.S. law.

Please also read the Socialight Privacy Policy. It is considered part of this agreement.

General Responsibilities

• You must be 13 years of age or older to use this service. If you are under 18, please check with a parent or guardian before you agree to these terms and get them to explain anything in this document that you might not understand.
• You agree not to use Socialight for any account purpose, and further agree to comply with all local laws regarding online conduct, acceptable content, and copyright. Any violations should be reported to Kamida using a Flag as inappropriate link or our support email address. While we will make every effort to respond appropriately to all reports, we do not guarantee that we will be able to do so.
• You will not impersonate any other Socialight user, or try to gain access to data held under any account other that your own.
• You accept responsibility for any and all activities that occur under your account name.
• You agree not to harm minors in any way.
• You agree not to impersonate any person or entity, including, but not limited to, a Kamida official, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Violation of any of these agreements will result in the termination of your Socialight account.
• While Socialight prohibits some types of conduct and content on its service, you understand and agree that Socialight cannot be responsible for the Content published with its service and you nonetheless may be exposed to such materials.
• You recognize that this service is in beta and that your use is at your own risk.
• You must inform Kamida before any commercial use of this service. We reserve the right to remove any commercial content from the Service.
  

Content

• By uploading, submitting or otherwise disclosing or distributing Content of any kind at or on the Site or otherwise through the Services, unless source quoted, you represent and warrant that you own all rights in the Content.
• You retain all of your ownership rights over any information or material you provide to the service (Content). By posting Content, however, you do give permission to provide the Content to users of the Socialight service and services provided by Kamida's business partners. Furthermore, you grant Kamida a worldwide, royalty free, and non-exclusive license to reproduce, modify, adapt, and distribute such Content on the Service. You also understand that we may collect fees for access to Content you provide to the service.
• You must own the Content you post to Socialight or have the right to post such Content from the rights-holder.
• You agree not to upload, post, email or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.
• We may, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Use.
• We do our best to provide you with tools to determine who has access to material that you provide to the service, but you recognize that others than those you intend to see it may be able to access any material.
  

If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide a notification that includes the following information:

• A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
• A description of the copyrighted work or other intellectual property that you claim has been infringed;
• A description of where the material that you claim is infringing is located in the service;
• Your address, telephone number, and email address;
• A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
• A statement by you, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.
  

Contacting You
The Socialight service notifies you about the things around you. This includes information about nearby places, notification about your friends activities and promotions directly relevant to where you are. We may communicate with you in the following ways

• sending you text messages (sms) and e-mail according to the settings in your account preferences.
• sending you text messages with promotions, free stuff and discounts, relevant to your location
• sending you a Socialight newsletter by e-mail (according to your settings)
• contacting you as part of a customer service survey (once a year or less)
• advise you of other services we offer that you may not have tried (quarterly)

All text messages will be sent while or immediately after you use the service, according to your preferences. We will never send you random, unsolicited, irrelevant text messages at indeterminate times. You can control the messages you receive in your account preferences.

Using shortcodes and location based services
We provide shortcodes and location based services to make Socialight easier to use. For example, you can access Socialight by sending a text to our shortcode, rather than entering m.socialight.com in your phones browser. You can also get us to find your phone automatically, rather than manually enter your address.

If you use Socialight via a shortcode and your mobile carrier supports location services, then you agree to be located by your mobile carrier. i.e. you consent for your mobile carrier to release their location data about your handset to Socialight, for the provision of the service. Please note that the service accuracy can vary depending on the user's situation. i.e. city vs. country location. Socialight has the right to suspend or terminate this service.

Network Charges
Most features of the Service are provided free-of-charge. However, even if a feature is free-of-charge. you may incur charges from your mobile network provider. Mobile network charges you may incur include but may not be limited to text messaging, multimedia messaging, and data network access charges. It is your responsibility to be aware of the fees assessed by your mobile network and to pay for these charges.

The Socialight Java Mobile application uses an especially large quantity of data network bandwidth. Therefore, we recommend that users of the Socialight Java Mobile application have a mobile network plan that allows for unlimited data usage for a fixed fee. If an unlimited data plan is not available from your mobile network provider, you should consider not using the Socialight Mobile application.

Representations and Warranties

• There is no warranty for this service, to the extent permitted by applicable law.
• In no event will Kamida be liable to you for any damages, including any general, special, incidental or consequential damages arising out of the use or inability to use the service (including but not limited to loss of data or data being rendered inaccurate or losses sustained by you or third parties or a failure of the service to operate with any other programs), even if we or any other party has been advised of the possibility of such damages.
• We reserve the right to refuse service to anyone for any reason at any time.
  

Changes
Kamida reserves the right to revise these Terms of Use at any time by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the then current Terms of Use to which you are bound.
